Commercial Debt Recovery

This page is for debts between companies — unpaid invoices, supply or service contracts, commercial rent and other contractual claims. The Collect.md homepage covers debt recovery in Moldova in general; here we deal specifically with recovery between legal entities.

What commercial debt recovery means

A commercial claim is a sum owed from a business relationship: goods supplied, services rendered, leased premises or another contract between companies. Recovery means documenting the claim, pursuing it amicably and, if needed, taking it to court and then to enforcement once an enforceable title exists.

Collect.md typically acts when the creditor is a company (SRL, SA or other legal entity) and the debtor is also a company. Claims against individuals follow a different regime and are not the subject of this page.

Typical B2B claims

We review commercial files when supporting documents exist. The most common situations:

  • Unpaid invoices for goods or services
  • Supply contracts with overdue payment
  • Unpaid service contracts
  • Overdue commercial rent
  • Trade credit, instalments or partner financing where a contract exists
  • Other contractual debts (transport, contractual penalties, uncontested delivery/acceptance acts)

When Collect can intervene

We step in once there is an identifiable claim and, as a rule, documents that support it. The file does not need to be “perfect” from day one: the first step is a review of what you have.

We can take a file still at notification stage, one stuck in negotiation, or one that already needs legal steps. We do not promise a fixed outcome or deadline — those depend on the documents, the debtor and how far the claim has gone.

Documents normally useful for assessment

The clearer the file, the faster the assessment. In practice the following are useful:

  • The commercial contract or accepted orders
  • Unpaid invoices and delivery or acceptance acts
  • Correspondence with the debtor (email, notices, acknowledgements of debt)
  • Account statements or a record of partial payments

The recovery path, in brief

Not every file goes through every stage. We set the intensity according to the documents and the debtor’s response:

  • Initial file assessment — what can be substantiated and what is missing
  • Amicable recovery — notice, communication, negotiation
  • Formal payment demand — when it is appropriate
  • Legal recovery — court action if out-of-court steps are not enough
  • Enforcement — after an enforceable title, through a judicial enforcement officer
  • Insolvency-related options — if the debtor is in liquidation or collective proceedings, where the file allows it

The risk of delay

Delaying pursuit of a commercial claim can make recovery harder: evidence weakens, the debtor’s position may change, and the right to claim payment can be affected by limitation. This page is not a substitute for analysing the time limits in your file.

If you have older claims, read the guide on the limitation period and ask for a file review rather than waiting further.

Next step

Send the file for a review: what can be substantiated, what is missing, and which path fits — amicable, legal, or both.

Frequently Asked Questions

What documents are needed to assess a commercial claim?

Typically: the contract or orders, invoices, delivery/acceptance acts, correspondence with the debtor and a payment record. If something is missing, we say so at review. The first step is a file assessment, with no upfront fee.

Do you only handle debts between companies?

This page covers B2B commercial claims. Recovery from individuals has its own rules; we discuss that separately, depending on the file.

Do we have to go straight to court?

No. Many files start with amicable recovery and, where appropriate, a formal payment demand. Court and enforcement come into play when out-of-court steps are not enough or the file requires it.
